What is the DMCA?

Overview of the Act

The Digital Millennium Copyright Act is a United States copyright law that addresses copyright infringement on digital platforms and websites. It provides a framework for copyright owners to request removal of infringing content while offering certain protections for online service providers.

Safe Harbor Provisions

The DMCA includes “safe harbor” provisions that protect online service providers from liability for copyright infringement by their users, provided they comply with specific requirements including responding appropriately to takedown notices.

Notice and Takedown Process

The DMCA establishes a “notice and takedown” system that allows copyright owners to request removal of infringing content by sending proper notifications to service providers.

Users whose accounts have been terminated may appeal the decision by contacting us with detailed information about why they believe the termination was inappropriate.

False Claims and Misuse

Penalties for False Claims

Submitting a false DMCA notice is a form of perjury and may result in legal consequences including liability for damages, court costs, and attorney fees.
